1. Acceptance of the Terms
By accessing or using BRECCIA, the user agrees to these Terms of Service and the Privacy Policy. Anyone using the platform for a company or other organization represents that they have authority to bind that organization to these Terms.
Commercial terms, statements of work, or agreements entered into with a customer organization may supplement these Terms. If they conflict, the specific instrument prevails to the extent of the conflict.
2. About BRECCIA
BRECCIA is an applied intelligence platform for the construction industry. It helps teams organize and consult documents, operational data, integrations, and industry references, including with artificial intelligence support.
TODO: preencher antes da publicação. Add the legal name, Brazilian company registration number (CNPJ), and address of the entity responsible for BRECCIA.
3. Eligibility
Users must have legal capacity to accept these Terms and use the platform in a professional context. BRECCIA is not directed to children. Anyone who does not agree to these Terms must not use the service.
4. Use by businesses
Organizations may administer workspaces, members, permissions, and content. Users must follow the internal policies and instructions of the organization linked to their account. Authorized administrators may control access and make decisions concerning data in the business workspace.
5. Accounts and credentials
Users must provide accurate information, keep credentials confidential, and use authentication methods securely. Accounts are personal unless BRECCIA expressly authorizes another arrangement. Suspected unauthorized access must be reported promptly.
Users are responsible for activity through their account to the extent permitted by law and contract, particularly when they fail to protect credentials or improperly share access.
6. Permitted use
The platform may be used for legitimate professional purposes involving the organization, consultation, and analysis of information, collaboration, document management, and support for construction processes, subject to the subscribed plan, granted permissions, and law.
7. Prohibited use
Users must not:
- violate law, third-party rights, confidentiality, or intellectual property;
- submit malicious code, interfere with security, or attempt unauthorized access to accounts or systems;
- circumvent platform limits, permissions, or technical measures;
- use the service for fraud, unlawful discrimination, harassment, or harmful activity;
- reverse engineer or improperly exploit the service, except where expressly allowed by law; or
- use results as the sole basis for decisions requiring technical, professional, or legal responsibility.
8. User content and data
Users and their organizations are responsible for the lawfulness, quality, accuracy, and permissions relating to documents, data, and instructions they provide or connect. They must hold all necessary rights and authorizations, including for personal data and confidential third-party information.
9. Data ownership
Users or their organizations retain all rights they already hold in documents, files, and data they upload or connect. BRECCIA does not acquire ownership of this content, and use of the platform does not transfer intellectual property to BRECCIA.
11. Third-party integrations
BRECCIA may enable connections to external services. Each integration depends on user authorization, technical availability, and the relevant provider's terms and policies. BRECCIA does not control changes, outages, or restrictions imposed by third parties.
12. Google Drive and Google services
When connecting a Google Account or Google Drive, the user authorizes BRECCIA to access and process information covered by the permissions displayed by Google to provide requested features, such as search, organization, document consultation, and use of documents as context.
Users may revoke authorization through their Google Account security settings. The integration is also subject to Google's terms and policies. Google does not sponsor or endorse BRECCIA, and connecting the service does not transfer ownership of user files.
13. Artificial intelligence features
BRECCIA may process content users provide or connect to find information, summarize documents, organize data, compare versions, suggest analyses, and generate contextual responses. BRECCIA may use necessary technology providers to operate these features, as described in the Privacy Policy.
14. Limitations of artificial intelligence responses
AI-generated results are support tools and may be incomplete, incorrect, inaccurate, ambiguous, or outdated, even when references are included. Users must critically assess responses and verify relevant sources and documents before acting.
15. User responsibility
Users decide how to use information and results provided by the platform and remain responsible for human validation, their instructions, source selection, and resulting decisions. BRECCIA does not automatically perform professional responsibilities assigned by law or contract to users or their organizations.
16. Technical and professional construction decisions
BRECCIA does not replace engineers, architects, lawyers, accountants, consultants, technical leads, or other qualified professionals. Information concerning costs, contracts, designs, standards, safety, engineering, architecture, planning, and construction decisions must be checked by responsible professionals before any decision or implementation.
The platform supports consultation, organization, and analysis; it does not issue professional responsibility records, assume technical responsibility for construction work, or guarantee the regulatory compliance of designs or decisions.
17. BRECCIA intellectual property
The platform, brand, interfaces, software, components, documentation, methods, and BRECCIA-owned content are protected by applicable law and belong to BRECCIA or its licensors. These Terms grant only a limited right to use the service during the contractual relationship and do not transfer those rights to the user.
18. Third-party services and content
Third-party references, databases, links, integrations, and services may be subject to their own licenses, availability, and rules. A reference or interoperability does not imply sponsorship, partnership, or endorsement unless expressly stated. Users must observe the terms applicable to each external service or item of content.
19. Service availability
We seek to keep the platform available and reliable, but interruptions may occur due to maintenance, failures, security events, external dependencies, or circumstances beyond reasonable control. Specific service levels apply only when formally agreed in a separate contract.
20. Changes to the platform
We may fix, update, add, replace, or discontinue features to evolve the product, meet legal or security requirements, and respond to provider changes. Where a material change affects contracted use, we will provide notice appropriate to the context and applicable commitments.
21. Security and confidentiality
BRECCIA uses reasonable measures to protect the service and processed information. Users must respect access and confidentiality controls, use only authorized content, and cooperate in the event of an incident. Additional confidentiality obligations may be established by contract with the customer organization.
22. Suspension and termination
BRECCIA may limit or suspend access for violation of these Terms, security risk, nonpayment, legal requirement, or use that may harm the platform or third parties, subject to applicable agreements. Where reasonable, an opportunity to cure will be provided.
Termination does not eliminate obligations that by their nature should survive, including those concerning intellectual property, confidentiality, payments, liability, and legally required data processing.
23. Account deletion
Users may request account closure and data deletion by emailing contato@breccia.ai, subject to identity verification, administrator permissions, contract, and applicable legal obligations. The Privacy Policy explains retention that may continue after closure.
TODO: confirmar com responsável técnico/jurídico antes da publicação whether the application offers a self-service path and add the exact instructions here.
24. Limitation of liability
To the maximum extent allowed by law and without excluding liabilities that cannot legally be limited, BRECCIA is not responsible for decisions made without required professional validation, misuse, inaccurate user-provided data, third-party unavailability, or indirect damages and lost profits not caused by conduct attributable to BRECCIA under law.
Financial caps, specific warranties, and allocation of responsibility between BRECCIA and a customer organization may be established in the applicable commercial agreement. Nothing in these Terms excludes non-waivable rights.
25. Responsibility for violations
Users and organizations may be held responsible under applicable law and contract for losses arising from unlawful use, infringement of third-party rights, unauthorized content, or breach of these Terms. Any determination will consider responsibility, causation, due process, and legal limits and does not create an automatic or disproportionate indemnity obligation.
26. Changes to these Terms
We may update these Terms to reflect changes to the service, law, or operational practices. The current version will be published on this page with a new date. Material changes may be communicated through other appropriate means and will apply prospectively, subject to agreements and applicable rights.
